Privacy Policy

1. Who is responsible for your information

ChampionChoice LLC, Registration No. 04028463, registered address 4137 Sauk Trail, Richton Park, IL 60471-1253, United States, is responsible for the personal information collected through championtowery.com. The person accountable for compliance with this policy is Terry Nichols, reachable at ChampionChoice@proton.me.

We are established in Illinois, United States, and apply relevant US and Illinois requirements. Because the Site is offered to users in Australia, we also handle Australian users’ personal information consistently with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

2. Scope

This policy explains what personal information we collect, why we collect it, what our legal basis is, who we share it with, how long we keep it, and the choices and rights you have. It applies to the website, all games available on it, our Game Development enquiry form, and our marketing.

3. What we collect

  • Information you send: name, email address, message, and any details you submit through the contact form or by email.
  • Technical information: the hosting provider may record IP address, browser and device type, referring page, requested path, and timestamps for security and diagnostics.
  • Age and cookie choices: browser storage used to remember age confirmation and cookie-banner choices. See section 9.
  • Game session data: a Game hosted on this Site may use local storage or a session identifier to run the game.
  • Support correspondence: messages you send us and our replies.

We do not collect payment card details, because the Games are free and we do not process payments. We do not collect sensitive information within the meaning of the Privacy Act, and we do not knowingly collect information from anyone under 18. You may use the Site without telling us your real name; where it is lawful and practicable, you may deal with us anonymously or under a pseudonym for general enquiries.

4. Why we collect it, and our legal basis

  • To reply to enquiries and support requests.
  • To remember age confirmation and cookie choices requested by the visitor.
  • To keep the Site secure, diagnose errors, and prevent abuse.
  • To measure aggregated visits and clicks only where the required consent has been obtained.
  • To comply with legal obligations and respond to lawful requests.

We collect personal information only where it is reasonably necessary for these functions, and we do not use or disclose it for an unrelated purpose without your consent, unless an exception under the Privacy Act applies.

5. Marketing and how to opt out

We send promotional messages only where you have expressly agreed to receive them. Every message identifies us and contains a working unsubscribe method that we action promptly, as the Spam Act 2003 (Cth) requires. You can also opt out by writing to ChampionChoice@proton.me. We do not add contact-form users to a marketing list automatically.

6. Who we share it with

We do not sell your personal information. We share it only with processors acting on our behalf, under contract and only for the purposes described above:

  • hosting and infrastructure providers for this Site and the Games;
  • analytics providers, to measure use of the Site and the Games;
  • advertising platforms, including Google, to measure and optimise our campaigns;
  • email providers, when you contact us or request a response;
  • professional advisers, and law enforcement or regulators where required by law.

Our commercial partners referred to in the Affiliate Disclosure do not receive your personal information from us.

7. Overseas disclosure

We are based in the United States, and personal information about Australian visitors may be stored or processed outside Australia, primarily in the United States and in countries where our hosting, email, security, or analytics providers operate. Before disclosing personal information overseas we take reasonable steps, as required by APP 8, to ensure the recipient handles it consistently with the Australian Privacy Principles. Information held abroad may be accessible to courts, law enforcement, or national-security authorities under local law. You can ask us at ChampionChoice@proton.me where your information is held.

8. Cookies

We use necessary browser storage to remember age confirmation and cookie-banner choices. Analytics or advertising cookies, if introduced, must remain disabled until the visitor gives the required consent. Games hosted on this Site may use first-party storage to run a session. You can block or delete cookies and site data in your browser.

9. How long we keep it

Support correspondence is kept while the enquiry is active and for up to 24 months afterwards, unless earlier deletion is requested and no legal need requires retention. Technical logs are retained according to the hosting provider’s security rotation, normally 30–90 days. Browser flags remain until the visitor clears site data or until their stated expiry.

10. How we protect it, and data breach notification

We use HTTPS, access controls, provider security measures, and monitoring for unauthorised access. No system is completely secure. If an eligible data breach occurs, we will notify affected individuals and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme, and meet any applicable notification duties in the United States.

11. Your rights

You may ask us to:

  • confirm whether we hold personal information about you and give you access to it;
  • correct information that is inaccurate, out of date, incomplete, irrelevant, or misleading;
  • request deletion of correspondence and other personal information where we have no legal reason to retain it;
  • object to optional marketing or analytics processing;
  • withdraw your consent where we rely on it.

Write to ChampionChoice@proton.me. We will respond within 30 days and we do not charge a fee for a routine request. We may ask you to verify your identity first. If we refuse a request in whole or in part, we will explain why in writing and tell you how to complain. We do not make decisions about you based solely on automated processing that would produce legal effects or similarly significant effects for you.

12. Complaints

If you have a privacy complaint, write to us first at ChampionChoice@proton.me and we will investigate and respond within 30 days. If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner at oaic.gov.au. You may also contact the appropriate authority in your US state where applicable.

13. Children

The Site is for adults aged 18 and over. We do not knowingly collect information from anyone below that age. If you believe a minor has contacted us or submitted information, contact ChampionChoice@proton.me and we will delete it unless retention is legally required.

14. Changes to this policy

We may update this policy. The current version is always available at championtowery.com/privacy with its effective date. Where a change is material we will notify registered users before it takes effect.
